A recent story regarding rent control published in the Commercial Mortgage Alert “Regulatory Roundup” stated that “Rent Control is back in vogue with many state and city lawmakers, putting lenders and investors on high alert.” Using innovative journalistic techniques, the story went on to look at the impact on lending in the Minneapolis St. Paul MSA following a vote by the citizens of St. Paul in November 2021 that capped rent increases at 3% per year. Citing Recursion data, the story went on to state that lending in the MSA fell by 31% from the end of November 2021 through Q1 2022 from the prior year period in the Fannie Mae DUS program. On July 8, 2022, Commercial Mortgage Alert reported that the GSEs are making fewer underwriting exceptions on their multifamily deals with affordability components in an article "Agencies Normalizing Underwriting", citing Recursion data on the percentage of affordable housing in Fannie Mae DUS production: "Based on recently available data on renter income in Fannie's portfolio, analysis from research firm Recursion Co. shows that 66% of the agency's non-REMIC multifamily production in May and June combined was affordable to renters earning no more than 80% of area median income." (substack.com) On January 27 2022, HousingWire published an article called “GSEs’ cash window loses some luster” that talks about how large nonbanks have increasingly moved to using swap transactions with the Enterprises.
